Software Installation By You
You must make every attempt to safeguard your data and other files during installation, when upgrading, or when installing an update. We do not assume responsibility for loss of data or any other losses that result from installation, upgrading, or updating of the software. Hard disks (including but not limited to all data or files) should be backed up on a regular basis and should always be backed up before you begin any installation tasks.Software Installation Service By Us
If you have purchased the optional installation service, we will install the software onto your web server. Installation includes basic configuration only, unless stated in writing prior to installation. We will not setup your items or any other elements. While we will make every attempt to safeguard data during installation, we do not assume responsibility for loss of data. Hard disks and all data on your server should be backed up on a regular basis and should always be backed up before we are called for service or installation. We are not responsible for any losss of data.Support Services
We provide technical support for all of our products. Technical support is only given through the support system in your customer area. If you have made modifications to the source code, you may be – at our decision – ineligible for our support service. The support system may be offline during site maintenance.Software Restrictions & Abuse
We reserve the right to close an account immediately if a customer violates the following restrictions.- The software may under no circumstances be distributed to any third party or individual.
- The software may be used to serve multiple users, but they must not be given access to its source code or other internal resources. Distribution of these resources is illegal.
- The software may only be used on one web domain (e.g. www.domain.com) per license.
- The purchased software may include a developing license. This license must not be used on public servers or to serve multiple users. Developing licenses are meant for testing purposes only. You are not allowed to run a productive site with a developing license.
- If an install file is marked (inside the source code) as protected, you are not allowed to modify the install file.
If our software is found to be stolen, distributed without permission, illegally obtained, or if the users of this software are found to be breaching any of the terms herein, we have the unconditional right to prosecute them to the fullest extent of the law.
Disclaimer Of Warranties
To the extent allowed by local law, this software is provided to you "as is" without warranties or conditions of any kind, whether oral or written, express or implied. We specifically disclaims any implied warranties or conditions of merchantability, satisfactory quality, non-infringement and fitness for a particular purpose.Limitation Of Liability
Except to the extent prohibited by local law, in no event will we be liable for direct, special, incidental, consequential or other damages (including lost profit, lost data, or downtime costs), arising out of the use, inability to use, or the results of use of the software, whether based in warranty, contract, tort or other legal theory, and whether or not advised of the possibility of such damages. Your use of the software is entirely at your own risk.Orders & Coupon Codes
The minimum order value is 7.5 EUR. A payout of a coupon in cash is not possible. One coupon code per order - coupons cannot be combined. Coupons are valid for 6 months. Coupons are in EUR only and are gross values (Bruttobetraege). All plugin purchases include free updates (versions 2.x, 3.x). Upgrades to newer versions of SocialEngine are not included.Refund/ Return Policy
The products available for purchase on our web site are downloadable. If you purchase one of our products, you will receive a payment confirmation via email. After you received this confirmation you will be able to activate and download the product in your customer area. Once you activated the product, no refunds will be given. We have this policy since it would be impossible for you to return your version of our software.It is your responsibility to familiarize yourself with this refund policy. By placing an order for any of our products, you indicate that you have read this refund policy and that you agree with and fully accept the terms of this refund policy. If you do not agree with or fully accept the terms of this refund policy, we ask that you do not place an order with us.
